Johnson & Johnson hit as jury awards 'excessive' $8 billion in damages

Johnson and Johnson J&J must pay $8B in Risperdal case: Jury

Johnson & Johnson's legal battles over opioid drugs and talc products may have made big headlines lately, but Tuesday, it lost big in an entirely different fight.

The case is one of thousands against Johnson & Johnson and its subsidiary Janssen Pharmaceuticals seeking damages in Pennsylvania and other states for failing to properly warn of Risperdal's side effects.

Responding at the time to accusations that it inappropriately marketed the drug to children, J&J said Janssen "did not direct sales representatives to promote Risperdal for use in children or adolescents, and it did not approve sales materials aimed at treating children or adolescents".

J&J, based in New Brunswick, N.J., said in a statement Tuesday it will immediately move "to set aside this excessive and unfounded verdict".

Mr. Murray's lawyers, Thomas Kline and Jason Itkin, said in a statement that the jury "resoundingly told Johnson & Johnson that its actions were deliberate and malicious".

But Johnson & Johnson called the award "grossly disproportionate with the initial compensatory award in this case, and the company is confident it will be overturned".

The large award for punitive damages will likely be reduced due to a violation of due process, according to Reuters, which noted that the U.S. Supreme Court in 2003 threw out a $145 million punitive damage award saying, "few awards exceeding a single-digit ratio between punitive and compensatory damages, to a significant degree, will satisfy due process". "Further, the plaintiff's attorneys failed to present any evidence that the plaintiff was actually harmed by the alleged conduct".

While the drug can treat certain mental health disorders, Murray's lawyers charged that it also has a tendency to create a hormonal imbalance, with elevated levels of a hormone called prolactin. Murray claimed that taking the Risperdal as a child caused him to develop breasts, an incurable condition known as gynecomastia.

More recently, a judge in Oklahoma ordered the company to pay $572 million after that state sued the drugmaker for its opioid marketing.

The jury, the company added, had not been allowed to hear evidence of the drug's benefits. It recently agreed to a $20.4m settlement with two counties in the U.S. state of OH over claims it fuelled the crisis there.

Murray said he was prescribed the medicine at age 9 for symptoms related to autism spectrum disorder, despite the fact that the FDA's approval of the drug in the 1990s was to treat schizophrenia and episodes of bipolar mania in adults.
