Judge Vacates Administration's Rule on Drug Prices in Advertising

Judge blocks Trump administration's move to require drug prices in TV ads US Big Pharma allowed to continue hiding ‘intimidating’ price info from customers in TV ads

"No matter how vexing the problem of spiraling drug costs may be, [Health and Human Services] can not do more than what Congress has authorized", US District Court Judge Amit Mehta ruled on Monday, blocking the order, which was due to go into effect on Tuesday.

In February, Merck CEO Kenneth Frazier and six other pharmaceutical executives testified in front of the Senate Finance Committee about ways to address rising prescription drug prices.

A federal judge in Washington struck down a Trump administration plan, set to take effect Tuesday, that would have required drugmakers to include pricing information in ads seen on TV.

"The price people pay for their drugs is not the list price anyways", Kottler told Yahoo Finance.

U.S. District Judge Amit P. Mehta in Washington, D.C., ruled in favor of drug manufacturers Merck & Co., Eli Lilly and Co., Amgen Inc. and the membership organization the National Association of Advertisers Inc. against forcing companies to display the cost of drugs that sell for over $35 a month.

"No matter how vexing the problem of spiraling drug costs may be, HHS can not do more than what Congress has authorized", Judge Mehta wrote.

A federal judge Monday blocked a major White House initiative on prescription drug costs, saying the Trump administration lacked the legal authority to require drugmakers to disclose their prices in TV ads. The logic behind the move would be to compel drugmakers to lower prices to avoid a potential consumer backlash if the general population is aware of their drug prices.

The United States District Court for the District of Columbia has vacated the Trump administration's rule requiring the disclosure of wholesale acquisition costs (WACs) for drugs in direct-to-consumer television advertising.

HHS spokeswoman Caitlin Oakley said the administration was disappointed by the ruling and "will be working with the Department of Justice on next steps related to the litigation".

According to the decision in the case, HHS sought, in adopting the rule, to do more than exercise its basic power to establish rules and regulations for the running and management of the federal public health programs of CMS. "Not only does the rule exceed the department's statutory authority and raise freedom of speech concerns, the focus on a medicine's list price creates confusion because it's not the price most patients will pay".

Judge Amit Mehta sided with the pharmaceutical companies and stated, "HHS can not do more than what Congress has authorized".
