Huawei chief legal officer comes out swinging at USA over blacklist

Huawei files motion to 'unconstitutional' U.S. ban Huawei moves US court against Trump ban

The summary judgment motion seeks to accelerate the legal process to give US customers access to Huawei equipment sooner, according to a Wednesday statement from Huawei. This came from now under-fire Chinese company's chief legal officer Song Liuping earlier today during a briefing held for media in Huawei's Shenzhen headquarters.

The main reason behind the clash is that U.S. officials have feared for a while that Huawei's technology could be used against the American nation as an espionage tool for the Chinese government.

The three South Korean suppliers told the Huawei executive that "they have no plans to pull back from their relationship with the telecom giant", according to KBS.

"If it's the case, that the Chinese Communist Party wanted to get information from technology that was in the possession of Huawei, it is nearly certainly the case that Huawei would provide that to them", he said.

Huawei says it is in communication with FedEx and will mount a legal defense if it finds its rights were infringed on following the diversion of packages.

Huawei's recent inclusion on an Entity List that prevents it from doing business with United States companies without a license could spell disaster.

The company argues that the ban is unconstitutional because Washington specifically singled out two Chinese firms - ZTE and Huawei - in its text.

However, last week the USA temporarily lifted some trade restrictions on Huawei, granting the company a licence to buy U.S. goods until August 2019.

The most recent round of negotiations between Beijing and Washington ended earlier this month without an agreement after Trump more than doubled duties on $200 billion in Chinese products.

In light of continuous back-and-forth between Huawei and the USA government over concerns of national security, Huawei filed a new legal motion challenging the ban on trade with US companies as unconstitutional. "Only speculation", Song said.

Google has also pulled Huawei's Android license, leading the Chinese giant to further accelerate its own operating system.

Huawei's Chief Legal Officer Song Liuping attends a news conference on Huawei's ongoing legal action against the USA government's National Defense Authorization Act (NDAA) action at its headquarters in Shenzhen, Guangdong province, China May 29, 2019. China responded by raising tariffs of 5 per cent to 25 per cent on NZ$92 billion worth of American goods.

"There is no gun, no smoke, only speculation", he said, accusing the U.S. of setting a "dangerous precedent". So much so that in March, the Chinese company filed a lawsuit against the United States government.

But he brushed away warnings by industry observers that the ban on buying US-made components puts the company's survival at risk.
