Trump's Battle With 'Obamacare' Moves To The Courts

The administration on Monday told the Fifth Circuit Court of Appeals that it agrees with a lower court ruling that the entire 2010 health law should be struck down.

Despite the president's confidence in his party's ability to enact a new health care law, congressional Republicans are not so sure.

But beyond pre-existing conditions protections, Mulvaney did not address how the 8.4 million Americans who have coverage through HealthCare.gov and state exchanges would all maintain their coverage under a potential GOP replacement plan.

In the Texas case, Trump could lose by winning.

"I look forward to seeing what the president is proposing and what he can work out with the speaker".

The footage of the attack has been frequently re-edited by Facebook users "to make it more hard for our methods to obstruct it", she states.

A flaw in this cynical calculation is that Republicans can not prevent Democrats from attacking them over health care by abandoning the issue; if that strategy worked, the 2018 elections would have gone very differently.

It was that concern - and qualms about the legal justification for the move - that drew objections from Health and Human Services Secretary Alex Azar, Attorney General William Barr and White House counsel Pat Cipollone as the White House debated its position on the Texas lawsuit, which was brought by a coalition of Republican-led states.

U.S. District Judge John D. Bates blocked a rule that was finalized previous year that allows small businesses and self-employed people to band together to purchase insurance known as association health plans.

Rules allowing association health plans began going into effect less than six months ago, and according to the Kaiser Family Foundation, which studies trends in health care, only a few plans have been announced. It's now fully supported by the Trump administration, which earlier had argued that only the law's protections for people with pre-existing conditions and its limits on how much insurers could charge older, sicker customers were constitutionally tainted. The judge questioned whether the requirements were compatible with Medicaid's central goal of providing "medical assistance" to low-income people. Bates found that administration regulations creating the plans were "clearly an end-run" around the Obama health law and also ran afoul of other federal laws governing employee benefits.

The Labor Department said in a CNN report it disagreed with the decision while the Justice Department said it will consider "all available options" after Bates' ruling.
