Federal prosecutors in California announced the indictment after a grand jury found late on Wednesday that there was probable cause to pursue charges against Avenatti.

The federal complaint in California charges Avenatti with 10 counts of wire fraud, accusing him of misusing more than $12 million he received on behalf of clients following settlements and other negotiations.

US Attorney for the Central District of California Nick Hanna said at a news conference in Los Angeles on Thursday that much of Avenatti's misconduct was interrelated.

Avenatti allegedly scammed another client, a paraplegic man, out of a $4 million settlement without the client's knowledge, according to the indictment.

Specifically, it alleges that Avenatti stole from a mentally ill paraplegic client on disability who won a $4 million settlement.

If convicted of the 36 counts, Hanna said Avenatti faces a maximum sentence of 333 years in prison, plus another two-year mandatory consecutive sentence for aggravated identity theft.

In another instance, Avenatti allegedly took $2.5 million from a $2.75 million client settlement payment to purchase his portion of a private jet, while falsely telling the client that the settlement was set up to provide monthly payments over eight years.

According to prosecutors, the lawyer withheld settlement payments from five clients, spending the money on his own lavish expenses, including a private jet that was seized by authorities on Wednesday.

The indictment claimed that he lied to an IRS revenue officer, opened a new bank account to receive funds related to credit card transactions at the coffee shops, and directed employees to deposit cash receipts into a bank account belonging to a auto racing outfit that Avenatti owned. "I intend to fully fight all charges and plead NOT GUILTY".

Avenatti has denied stealing from clients and tweeted a statement signed by Johnson praising him as an "honest and ethical attorney".

"I look forward to the entire truth being known as opposed to a one-sided version meant to sideline me", Avenatti, who is free on a $300,000 bond, wrote on Twitter on Thursday.

"Money generated from one set of crimes was used to further other crimes, typically in the form of payments created to string along victims, so as to prevent Mr. Avenatti's financial house of cards from collapsing", Hanna said. Prosecutors said he allegedly told Johnson that he had not received the payout from a settlement from Los Angeles County yet, but instead gave him at least 69 payments worth an estimated $124,000 in total and paid for his assisted living facility.

Prosecutors also accuse Avenatti of filing fraudulent applications to a bank in MS, to obtain $4.1 million in loans and making false statements when his firm was facing bankruptcy proceedings.

In addition to Client 1, Hanna said, Avenatti followed a similar pattern with four other clients.

Avenatti also failed to file tax returns for both of his law firms, Eagan Avenatti and Avenatti & Associates, in 2015, 2016 and 2017, the government charged.

In New York, Avenatti was accused of extorting Nike. Avenatti continued to lie to his client through last month, according to the indictment. Echoing allegations by Avenatti's former law partner Jason Frank, the grand jury accused Avenatti of signing multiple false court statements, under penalty of perjury, hiding substantial revenue from Frank, the IRS and other creditors.
