In its US case, Huawei is taking aim at a provision in the 2019 National Defense Authorization Act.

It claims that the USA is improperly targeting and punishing Huawei without giving the company the chance to argue its case and "damaging its reputation".

The company is challenging the USA law as an unconstitutional "bill of attainder", or a measure that targets a specific individual for penalties without a trial.

The Chinese company Huawei is taking legal action against a USA ban on its products as it faces intense global scrutiny over claims it is a security threat.

"This ban not only is unlawful, but also restricts Huawei from engaging in fair competition, ultimately harming United States consumers", Guo said. "We look forward to the court's verdict, and trust that it will benefit both Huawei and the American people".

While Huawei had very little share of the USA market before the bill, it is the world's biggest telecoms gear maker and is seeking to be at the forefront of a global roll-out of fifth generation (5G) mobile networks and services.

On Thursday, Guo said that "Huawei has not and will never implant "backdoors".

Chinese tech giant Huawei is launching a US court challenge to a law that labels the company a security risk and would limit its access to the American market for telecom equipment.

Turnbull also explained that Australia's decision to ban Huawei and ZTE last summer was carried out to defend the country's sovereignty and as a "hedge against changing times".

The NDAA bans the US government from doing business with Huawei or compatriot peer ZTE Corp or from doing business with any company that has equipment from the two firms as a "substantial or essential component" of their system.

Huawei accuses the USA government of hacking its servers and stealing its emails and Huawei source code, as well as attempting to influence United States allies and other governments worldwide to enact similar bans against the Chinese company.

Update 1 (9:22PM EST): Huawei is suing the USA governemnt for singling out Huawei and damaging its reputation without providing proof that the company is a threat as the U.S. congress claims and without allowing Huawei due process to reach a resolution.

"I don't see how (Huawei) can really escape that result", said Schwinn.

The high-profile Huawei executive was arrested by Canadian authorities at an airport in Vancouver in December 2018 on behalf of the United States, which seeks to prosecute her on charges related to fraud.

Australia's ties with China have deteriorated since 2017, when Canberra accused China of meddling in its domestic affairs.
