"The Labor Party did less in six years than we did in last year alone, Mr Speaker. They should have an election", he said.

"The people of Australia will remember this day and know that this is now on your head", the Prime Minister said to Mr Shorten in Parliament.

Mr Morrison ruled out calling a snap election, saying the vote was not a no-confidence motion in his government and he was still planning for a national poll in May.

About 1,200 refugees are estimated to be in exile in Nauru and Papua New Guinea's Manus, where they've been indefinitely detained for nearly six years.

He said the new laws only allowed the minister to refuse entry to Australia if someone had been sentenced, not if they were only facing charges.

Prime minister Scott Morrison will speak at the National Press Club in Canberra on Monday - where he will argue only his government can protect Australians from local and global threats.

"My job now is to ensure that the boats don't come", he told reporters at Parliament House.

"If they don't come, it will be because of the work and the decisions we are now taking and the actions we are putting in place", Morrison said.

He said the move was to deal with "the prospect of arrivals as well as dealing with the prospect of (medivac) transfers".

A fishing boat carrying Vietnamese asylum seekers neared the shore of Australia's Christmas Island, taken in 1993.

As a result, a "range of strengthenings" will boost Operation Sovereign Borders, but certain details of the stronger capacity won't be publicly revealed.

Earlier, Opposition Leader Bill Shorten sent his own message to would-be asylum seekers.

Opponents pointed out that the bill applies only to people already on Nauru and Manus Island, meaning new arrivals would not be eligible for transfer to Australia.

"But when you're in a village in Indonesia and someone is selling you a product, there's no protection or truth in advertising for people smugglers".

The government says the Christmas Island re-start will cost about $1.4 billion over four years.

Shonky bankers could soon be jailed for up to 15 years and corporate crooks fined up to $525 million.

The legal advice, which was tabled in Parliament on Tuesday afternoon by the Speaker of the House of Representatives, Tony Smith, raised the stakes by turning the bill into a money bill that could become a test of confidence in the government.

The legislation demonstrates the government's weak hold on power and will put asylum seeker policy at the forefront of campaigning ahead of elections that Morrison wants to hold in May.
