This is after the lawyers of Ghosn deployed an article of the Constitution which is not used much.

According to Friday's edition of the Nikkei business daily, Ghosn paid almost $50 million to businesses run by two Middle Eastern acquaintances from the "CEO reserve", a pot of cash that the boss was able to use at his discretion. This is after the attorneys of the executive lodged a request in the District Court of Tokyo which could not be refused legally.

The shock move was the latest in a series of unexpected twists in a case that has gripped Japan and the business world since the once-revered auto tycoon was arrested on his private jet at a Tokyo airport on November 19.

Earlier this week, the court approved an extension to Ghosn's detention until January 11, after re-arrest by prosecutors who accuse him of aggravated breach of trust in transferring personal investment losses to Nissan.

During the hearing, slated to be held at the Tokyo District Court from 10:30 a.m. on Tuesday, Ghost will be allowed to voice his opinions in court for the first time since his arrest on November 19. on allegations he vastly under-reported his remuneration.

"Mr. Ghosn today submitted a request for the disclosure of the reasons for his detention".

Ghosn is scheduled to face a Tokyo courtroom Tuesday, his first public appearance since his arrest, as his lawyers demand to know why his detention is continuing. Prosecutors have accused him of transferring personal trading losses to Nissan, but have yet to indict him on this allegation.

Carlos Ghosn will finally see the inside of a court room next week, nearly two months after his arrest on financial crimes. The legal system has received criticism internationally.

Authorities are pursuing three separate lines of inquiry against the 64-year-old Franco-Lebanese-Brazilian executive, involving alleged financial wrongdoing during his tenure as Nissan chief.
