President Donald Trump will shut down his personal charity amid allegations he used it for political and personal gain, New York Attorney General Barbara Underwood announced Tuesday.

Mrs Underwood is continuing to seek more than $2.8 million (£2.2m) in restitution and has asked a judge to ban the Trumps temporarily from serving on the boards of other NY nonprofit organisations.

The state attorney general filed a lawsuit against the Trump Foundation in June, accusing it of "persistently illegal conduct". The lawsuit will continue in court because it also seeks two other outcomes: $2.8 million in restitution, plus penalties, and a ban on Trump and his three eldest children serving on the board of any other NY nonprofit.

Trump's attorneys maintain that the lawsuit is politically motivated, but a judge declined dismissing the case last month.

Donald Trump presents a mock check from the Trump Foundation representing $100,000 to members of the Puppy Jake Foundation, which provides military veterans with trained service dogs, in Davenport, Iowa, on January 30, 2016.

Court filings suggest that Underwood will work with a state judge and members of her office to redistribute the Trump Foundation's remaining $1.75 million to other charitable agencies.

The closure is a concession by the president in an investigation he called a partisan attack.

'This is an important victory for the rule of law, making clear that there is one set of rules for everyone, ' she noted.

It also seeks to bar Mr Trump, his sons Eric and Don Jr and daughter Ivanka from serving on the boards of other NY charities.

The Trump Foundation didn't not immediately respond to Fox News' request for comment on Tuesday.

The motion had argued that the US Constitution immunised Trump from Underwood's claims alleging breach of fiduciary duty, improper self-dealing, and misuse of assets belonging to the Foundation.
