US Supremes Won't Hear Appeal of FCC's 2015 Net Neutrality Order

Supreme Court rejects industry challenge of 2015 net neutrality rules Supreme Court Rejects Net Neutrality Case

President Donald Trump's administration asked the U.S. Supreme Court on Monday to allow it to end a program introduced by former President Barack Obama that protects thousands of young immigrants who live in the United States without legal status. In conjunction with the Trump administration, USTelecom requested that the ruling from the US Court of Appeals for the District of Columbia Circuit be overturned on the basis that the Federal Communications Commission has no congressional authority to impose common-carrier obligations on broadband internet access service, The Hill said.

Like the case turned away by the Supreme Court previous year, this one was an appeal of a lower court decision upholding a local sheriff's refusal to issue a permit. Four of nine justices must agree to hear a case, but only three voted to grant the petitions. Justices Clarence Thomas, Samuel Alito and Neil Gorsuch indicated that they would have opted for Munsingwear vacatur, which would have left the D.C. Circuit's ruling without any precedential value.

The new FCC position took effect in June.

Jessica Rosenworcel, the Federal Communication Commission's only Democratic Commissioner, noted that the FCC had argued that because the Trump-era FCC had repealed the 2015 rules, the 2016 decision was moot and should be wiped from the books.

The NCTA – The Internet & Television Association said it is "not surprising" that the Supreme Court declined to hear a case that went back to the Wheeler-era FCC. But today the Supreme Court refused to do so. Justice Brett M. Kavanaugh and Chief Justice John.

The legal moves reflected a desire by conservatives and industry players to cement the FCC's repeal of net neutrality rules, which were created to restrict Internet service providers' ability to manipulate loading speeds for specific websites or apps. The Pai-led FCC is defending its net neutrality repeal against a lawsuit filed by dozens of litigants, including 22 state attorneys general, consumer advocacy groups, and tech companies. They know their repeal of net neutrality was so filled with procedural missteps and outright fraud that they're anxious it will be overturned by next year's net neutrality lawsuits, opening arguments for which begin in February.
