Supreme Court rejects NI abortion law appeal Supreme Court rejects NI abortion law appeal

The Commission welcomed the court's opinion that the law was incompatible with the European Convention but said it was disappointed in the ruling that it did not have sufficient powers to take the case.

The BBC's health correspondent in Northern Ireland calls the situation "a weird set of circumstances".

Ms Jackman, victor of the 2018 Lawyer of the Year Award at the Eclipse Proclaim Modern Law Awards, led an Article 8 and Article 14 case (A and B v Secretary of State for Health) in defence of women from Northern Ireland seeking NHS-funded abortions in England.

While ruling against the NIHRC's appeal for lack of standing, several members of the U.K. Supreme Court said the Northern Irish abortion restrictions did appear to conflict with European human rights guarantees. A fifth agreed it it incompatible only in casese of fatal fetal abnormality. The woman, Amanda Mallet had approached the United Nations asking it to denounce the prohibition on abortions in cases of fatal foetal abnormalities as "cruel and inhumane". While campaigners across the world are rejoicing the victory, they are also remembering India's Savita Halappanavar who is said to be the trigger behind the referendum. "Moreover the difficulty in devising a confident and reliable definition of serious malformation we regarded as a potent factor against a finding of incompatibility".

HSE SHCPP Programme Lead Helen Deely said: "If a woman is in any way concerned about her health following taking an abortion pill or travelling overseas for an abortion, we encourage her to attend a free post-abortion medical check-up funded by the HSE". We demand abortion rights.'.

"It would therefore be deeply disingenuous for pro-abortion campaigners to suggest that there is any legal requirement to change the law in Northern Ireland".

"The judges made absolutely clear that if a woman [who had suffered such a case] was brought forward they would find that our laws are incompatible with human rights", said Les Allamby, the head of the NIHRC, the Guardian reported. It also "strongly advised the clinical professional community, health and social care regulators... to consider the law, including any necessary constitutional change" to manage such emergencies.

The matter could be taken up by either the Northern Ireland Assembly or the Parliament of the United Kingdom.

The Northern Ireland Assembly is now suspended.

Labour MP Stella Creasy said women in Northern Ireland should have the same control over their bodies that Arlene Foster - the leader of the Democratic Unionist Party propping up PM Theresa May's government-has over Westminster.

Another judge reached the same conclusion with regards to fatal foetal abnormalities, but not in the case of rape and incest.

Last month, the Republic of Ireland overwhelmingly voted to legalize abortion, a historic move.

"The analysis and comments from the court on the issue of incompatibility will be clearly heard by this House and politicians in Northern Ireland".

It cited one online provider as reporting that 1,217 women from the island of Ireland received the medical abortion pill from its service previous year - while another cited a figure of 878 women.

The Supreme Court's majority view was the ban in those specific cases was not compatible with article 8 of the ECHR - the right for respect for private and family life. "Any wider move to decriminalisation is off the table now".

The push for the legalization of abortion in Northern Ireland is not a new campaign, and has gained traction with the overturn of an abortion ban in the Republic of Ireland only weeks ago. The time is ripe for steps to be taken which ensure that abortion law throughout the United Kingdom is consistent. "There is a right to life in the whole process of human rights law".
