Regarding elections of the Maharashtra Cricket Association (MCA) that were slated to take place on Wednesday, Chief Justice Dipak Misra said, "First focus on the core issue, that is drafting the constitution".
The MCA claimed through Additional Solicitor General Tushar Mehta that it had already adopted a new constitution in line with the Lodha panel recommendations and that had been cleared by the High Court.
The copy of the amended constitution sent by the MCA secretary to the COA "substantially deviates from the reports of Justice Lodha Committee", said the CoA status report.
It asked state cricket bodies and BCCI office-bearers to give their suggestions with regard to the draft constitution to the amicus curiae before May 11, the next date of hearing.
The reconsideration means that, if the 2016 judgment is reversed, the states with multiple cricket associations such as Gujarat and Maharashtra can vote on a rotational basis.
The CJI however, assured that the court will have a relook at the "one state one vote" norm to examine the plea for giving independent voting rights to Vidarbha, Baroda and other associations which have been deprived voting rights on account of the Lodha panel recommendations of "one state one vote" policy.
The COA had in October a year ago filed a draft constitution of the BCCI incorporating suggestions of the Justice R M Lodha panel on reforms in the cash-rich cricket body.
"We are on the principle of inclusivity and not on the principle of exclusivity", the CJI said insisting that Northeastern states can not be denied any voting right merely because they do not produce quality cricketers.
The apex court has also decided that the Northeast states would have representation and that full member status will be given to them.
