A businessman fighting for the "right to be forgotten" on Google has won his "unprecedented" High Court action against the tech giant.

The two linked cases are: NT1 v. Google and NT2 v. Google, High Court of Justice, Queen's Bench Division, Case No.'s HQ15X04128 and HQ15X04127.

The businessman, who can not be named due to reporting restrictions, was convicted over a decade ago for conspiring to intercept communications.

Their lawyers said their claims, which were brought under data protection law and for misuse of private information, were the first of their kind to be made in England.

The businessman who lost his case had complained about three links returned by Google providing information about his conviction for "conspiracy to account falsely", for which he received a sentence of four years.

The lawsuit and judge's order came after Google initially refused to remove search results pertaining to the man's convictions (including results that linked to news articles), which the petitioner claimed were both harmful and no longer relevant, and, hence, subject to erasure due to the Right to be Forgotten.

"We work hard to comply with the right to be forgotten, but we take great care not to remove search results that are in the public interest", it added.

"There is an inherent tension between an individual's right to privacy and what information the public interest requires be available", said solicitor Ben Rose, who is based at law firm Hickman & Rose.

"We are pleased that the Court recognized our efforts in this area, and we will respect the judgments they have made in this case", the company said. The right of people to rehabilitation is an important one.

"The search result in question involved a decade-old criminal conviction, reportedly for 'conspiracy to intercept communications.' A similar case was decided the other way by the court". Now, the unnamed plaintiff will have his request honored by Google.
