The father of a 3-year-old girl whose body was found near the family's suburban Dallas home less than a year after she was adopted from an Indian orphanage was indicted Friday on a capital murder charge.

Weeks later, when a search dog found the girl's body in a pipe that runs under a roadway, Mathews came to the police station in Richardson to change his account.

Prosecutors said the capital murder charge, which could carry the death penalty, was filed after an autopsy determined his daughter died from 'homicidal violence'.

He told police that he forced Sherin to drink her milk and then removed her body from the house after she choked and died.

Mathews previously was charged with injury to a child, a first-degree felony punishable with a maximum 99 years in prison, police in the Dallas suburb of Richardson said.

According to court records, Wesley Mathews, used a "deadly weapon" in the death of Sherin but the "exact nature and description" was not presented to the grand jury.

He remained behind bars at the Dallas County Jail on bond of $1 million.

The adoptive father of 3-year-old Sherin Mathews could face the death penalty.

The girl began to choke, coughed and her breathing slowed, the affidavit said.

Despite the limited details about what actually happened to Sherin, Johnson said she's confident her team will be able get justice. "Eventually Wesley Mathews no longer felt a pulse on the child and believed she had died".
