In a new development to the issue of Rohingya Muslims, the Centre has conveyed it to the Supreme Court of India that it can not allow the nation to become the refugee capital.

Represented by senior advocate, Gopal Subramanium, the NHRC said that the refugees had the right to approach the Supreme Court to secure their basic rights such as education, health care and security. The matter has been listed to March 7.

Senior advocate Rajeev Dhawan, who had earlier appeared for the NHRC and is now a petitioner-in-person, responded to Chandrachud's query: "When someone comes to your border and says I am a refugee, it has to be determined whether he is one or not". "India will then become the refugee centre of the world", he said. "We can not push them back to the jaws of death", Kumar said.

Senior lawyer Rajeev Dhavan, who had intervened in this case, supported Mr Bhushan's contention that "if somebody comes to your border and says, I am a refugee, he can not be blindly pushed back".

He urged the court to defer hearing the case and leave it to the executive government to address the issue at diplomatic levels. Nariman submitted that 80 percent of the Rohingyas have been affected due to the genocide in Myanmar and are escaping the country but they are being subjected to chilli sprays and stun grenades by the BSF, while trying to enter India. These matters are best left to the government to decide.

Bhushan however pointed out that the Centre has a policy to welcome Hindu, Sikh and others, but not the Muslims from other nations.

The two refugees, in their fresh plea, have sought protection and welfare of Rohingyas in India against the August 8, 2017 proposal of the MHA directing all states and UTs to expeditiously initiate deportation process against illegal immigrants from Rakhine.

The refugees are fleeing a military operation in which security forces and Buddhist mobs have killed men, women and children, looted homes and torched Rohingya villages.

The National Human Rights Commission raised the issue of the Rohingya refugees in the Supreme Court today.

Various other pleas, including those by ex-RSS ideologue and Rashtriya Swabhiman Andolan leader K N Govindacharya, the CPI (M) youth wing Democratic Youth Federation of India (DYFI) and the West Bengal child rights body have been filed in the apex court on the matter.
