Illinois sued for prohibiting ill child from using medical pot at elementary school Girl should be allowed to take medical marijuana at school: suit

The state of IL prohibits the use of medical marijuana on public school property.

An assistant attorney general told the court that his office would allow the school to administer the drug for the next week without fear of prosecution and until his office can figure out how to address the state law that prohibits possession or use of marijuana at school.

When it comes to medical marijuana and children, things can get a little legally murky.

The ruling comes after the girl's parents sued Schaumburg School District 54 for the right to take medical marijuana at school.

Ashley has suffered from seizures for years.

The 11-year-old student is being treated for leukemia with chemotherapy. The Surin's said Ashley has improved dramatically since she has been getting the medical marijuana treatments. The cannabis, combined with a special diet, are helping Ashley lead a better life, according to her mother. At the Dirksen Federal Building Friday, U.S. District Judge John Blakey granted the school district an exemption to administer medical marijuana to her if necessary.

The Surin family says they may need to take their fight to the federal level because current law doesn't allow their daughter to travel to several states with her medication. "It's not a drug. She can viably attend school". "It hasn't caught up with reality".

The family agrees. They said the state's current medical marijuana laws do not meet reality. "And now she can think clearer and she's more alert".

Superintendent Andy DuRoss said officials were working to accommodate the girl as best they could within the law - but added the school would comply with whatever the court ruled.

The Illinois Attorney General agreed not to prosecute and the school district said its goal was to have Ashley back in the classroom with no legal consequences for staff who administer the medicine.

Kriha credited Ashley's family for pressing her case and the state's attorney general's office for showing flexibility.

The lawsuit, filed Wednesday against School District 54 and the state of IL, could have far-reaching implications. "The school would like to see legislative change so just not Ashley can benefit, but other students can as well".

Occasionally, when the patch is insufficient to control her seizures, she uses cannabis oil drops with small amounts of THC on her tongue or wrists to regulate her epilepsy, the suit stated.

Colorado amended its law in 2015. The measure was called Jack's Law, for Jack Splitt, a 15-year-old with cerebral palsy who died that year, after the law was passed.
